Sparks: Afghan woman deported from US in first use of 'alien terrorist' court
Strip away the word 'terrorist' and what remains is this: fear of the stranger, dressed in the language of justice, and the powerful do not need the charge to be true, only useful.
Do not call it a court. Do not call it justice. Call it what the exile knows it to be: a door closing, quickly, before she can name what she is being shut out of.
Rome proscribed the kin of the condemned. Byzantium punished the family of the traitor. Now a resident, charged with nothing, is expelled for what her relatives did - the foundation stones of tyranny, repointed and reused.
That a lawful resident, accused of no crime, should be banished for associations she neither chose nor committed - this is the general warrant reborn, and a nation that forgets why it forbade such power will deserve what it builds with it.
A woman packed a suitcase. She had obeyed the laws, paid what was owed, harmed no one. Men in a room decided she was dangerous because of what other people did. They called this safety. She called it a plane ticket.
They did not convict her because she was dangerous. They convicted her because her existence required a category that did not yet exist, and the institution's hunger for the category is the whole of the evidence.
The reformers have torn down the oldest fence in the law - that a man answers for his own deeds and no one else's - without ever pausing to learn why it was built, which was to stop exactly this.
Trace the operational sequence: a family link enters as input, a tribunal processes it, and a lawful life is the output - the mechanism was designed for this result, and the designers must not be permitted to call it a malfunction.
She worked the lawful years, held the resident's papers, lived under the flag they say she owes allegiance to - and now they tell me she is not one of us. Well, what is a resident, then, if her residence can be taken without a charge?
As water finds the lowest channel, so a tribunal named for terror finds the person least able to resist it - the mechanism reveals itself by where it flows first, and it flowed first toward a woman with no charge to answer.
They opened a brand-new courtroom, polished and proud, and the very first guest was a woman nobody had accused of anything - which tells you all you need to know about what the room was built for.
The court is new. The custom is old: punish the family, call it law, and let everyone watch quietly. The watchers watched. That is the whole of it.
We could build tribunals that require evidence, charge, and proof. We built one that runs on family names instead. The distance between those two facts is a choice, and the choice was made before the first case arrived.
In every court from Fez to Delhi I was received by judges who demanded witnesses and evidence before judgment; here is a court that takes the family for the witness, the blood for the proof, and the traveler for the crime.
She stood in the cold holding papers that said she belonged, and the papers burned as fast as any promise - the cold does not ask what your family did, and neither, it turns out, did the court.
